Subject:      WRIT PETITION NO. 31 OF 2023 TITLED “MUHAMMAD QAISER ABBASI VS. GOVERNMENT OF PUNJAB ETC.” FILE IN THE LAHORE HIGH COURT, RAWALPINDI BENCH, RAWALPINDI

I am directed to refer to the subject cited above and to state that Mr. Muhammad Qaiser Abbasi and 51 other School Guards of Rawalpindi District have filed the subject writ petition in the Hon’ble Lahore High Court, Rawalpindi Bench with the prayer that their contract appointment may be regularized. They, in support to their contentions before the Hon’ble Court have presented orders for regularization of School Guards issued in some districts of the Punjab as precedent.

2.                     On the other hand, clear guidelines / directions were issuedto all the CEOs (DEAs) in Punjab vide this department’s letter No. SO (SE-IV) 2-116/2022 dated 13.02.2023 that School Guards cannot be regularized as per Section 3(2)(a) of the Punjab Regularization of Service Act, 2018 (copy enclosed). However, numerous regularization orders of School Guards still have not been withdrawn by the competent authorities concerned due to which this department facing litigation by the School Guards who seeking regularization.

3.                     Iam therefore, further directed to request you to pass directions to the competent authorities of School Guards concerned to immediately withdraw regularization orders of School Guards. Moreover disciplinary proceedings under the PEEDA Act, 2006 may be recommended against the competent authority of School Guards concerned who have not withdrawn regularization orders after issuance of guidelines / direction in this regard vide above referred letter dated 13.02.2023.
