Federal Tribunal’s Decision Brings Relief to Government Employees on Advance Increments:
In a welcome move for government employees, the Office of the Military Accountant General (MAG), Rawalpindi, has issued a new government notification following a key decision by the Federal Service Tribunal (FST), Islamabad. The tribunal’s judgment dated October 16, 2023, in Appeal No. 183(P)CS/2020, filed by Muhammad Ishfaq vs FOP & others, has led to the restoration of advance increments for officials who acquired higher qualifications such as FA/F.Sc or BA/B.Sc.
Previously, these increments had been disallowed or deducted based on earlier interpretations by the Finance Division (OM dated 18.06.2011). However, the FST ruling overturns that, confirming that employees who either got promoted through reorganization or qualified through prescribed departmental exams are once again entitled to their advance increments. SUBJECT: JUDGMENT DATED 16.10.2023 PASSED IN APPEAL No. 183 (P) CS /2020 FILED BY MUHAMMAD ISHFAQ VZ F.O.P & OTHERS IN THE FEDERAL SERVICE TRIBUNAL ISLAMABAD
Ref:- This office Circular No. Pay/AO-1/AAO-Advance Increment dated 17.12.2024.
This office is receiving applications from individuals as well as references from different Controller’s offices on the subject matter. It is intimated that FST has already restored advance increments on acquiring higher qualification FA/F.Sc and BA/B.Sc to all those officials from whom the said increments were deducted / disallowed as per Fin Div vide OM No. F.1 (6) Imp/2000-392 dated 18.06.2011 on the plea that they were promoted to higher scale on Re- organization of JA/SA or on qualifying prescribed examination.
2. Copies of both judgments in respect of Mr. Zahoor Ahmed AAO/21788 and Mr. Muhammad Ishfaq AAO/24653 along with Fin Div OM No. F.1 (6) Imp/2000-Val-XXII-338 dated 29.11.2024 are hereby again enclosed with the request to entertain all applications in this regard in the light of above referred judgments and Fin Div orders.
