CIRCULAR
No.12/S.O/LIT-II/BOR/2024/2591 Despite repeated instructions issued by Board of Revenue through its office memorandum dated 23.01.2013 and even dated 05.01.2021 as well as such directives issued from time to time, thereby, following officers were appointed as Focal Persons to act as Incharge of respective litigation branches to look after, monitor and report the status of pending litigations to the heads of the department/offices and to this Board and also to follow the law, rules & instructions to this effect to defend the govt. interest.

2. However, it is observed with grave concern that neither the Focal
Persons nor the said litigation branches are effectively & vigilantly doing their job as envisaged to above. Consequently, the complaints are received from the Govt. Law Officers that lower sub-ordinate revenue officials are directly submitting the comments before the Honorable Courts at their own without checking, vetting and proper approval from the heads of their offices and even without consulting with the Law Officers of Govt. of Sindh. Due to this vague practice, the litigations involving the Govt. interest are not being properly persuaded. So much so, the comments/ objections are inordinately delayed or not filed in time.
3. In view of foregoing concern, it is therefore, directed that all the heads
of above offices / departments to immediately activate the functioning of litigation branches in full swing, Issue instructions to the Focal Persons to timely file the comments / objections before the Honorable Courts duly vetted as directed above, to hold fortnightly review meetings with the quarters concerned and to send the monthly Court Returns to the Deputy Secretary (Litigation), Board of Revenue Sindh, Hyderabad regularly without fail. Besides, the Focal Person to ensure the compliance of the instructions of law department &SGA&CD already issued to this effect in relation to court litigations in letter & spirit.
4. Failure to above and/or any case which involves the government interest wherein, the Government side is debarred due to non-pursuance or an ex-parte / adverse order / decree/judgment is passed against the government interest, such act shall deemed to be a “misconduct”to initiate disciplinary proceedings under Sindh Civil Servants (E&D) Rules, 1973 against defaulting officer / official.
