Sindh Govt Abolishes Deceased Quota Hiring Following Supreme Court Verdict – Full Legal Opinion Inside:
In a significant development, the Government of Sindh’s School Education & Literacy Department has officially issued instructions to cancel future appointments under the Deceased Quota (DQ), following a binding judgment from the Honourable Supreme Court of Pakistan in C.P. No. 3390/2021, dated 26th September 2024. The legal opinion received from the Regulation-Wing, Services, General Administration, and Coordination Department (SGA&CD) has clearly declared that appointments made under the deceased quota are unconstitutional, violating fundamental rights under Articles 3, 4, 5(2), 18, 25(1), and 27 of the Constitution of Pakistan.
This directive affects all pending deceased quota cases where appointment orders were not issued before 26-09-2024, effectively declaring such requests null and void. Officials and institutions including PITE, LNFE, TTI, Curriculum Jamshoro, and Chief Engineers Education Works are instructed to strictly adhere to the Supreme Court’s ruling.

SUBJECT: LEGAL OPINION IN THE CASES OF APPOINTMENT AGAINST DECEASED QUOTA.
I am directed to refer to subject noted above and to enclose herewith a copy of legal opinion/advice of Regulation-Wing, SGA&CD regarding appointment against deceased quota.
2. This department has received numerious requests/cases of different nature for clarification/guidelines regarding appointment against deceased quota, which were sent to Regulation- wing, SGA&CD for seeking legal opinion vide this department’s letter dated 21-02-2025 (copy enclosed). The Regulation-wing, SGA&CD has accordingly tendered the advice/opinion, which is reproduced as under:
“It is stated that recently Hounorable Supreme Court of Pakistan in its Judgement passed in C.P No.3390/2021 dated 26-09-2024 has declared appointment of civil servant on deceased quota is ultra vires to Article -3,4,5 (2),18 25(1) and 27 of the constitution of Pakistan. Moreover, Law Department has informed to all Administrative Departments that Honorable Supreme Court of Pakistan in civil petition No. 3390 of 2021, held recruitment against Deceased Quota under Rule-11-A of the Sindh Civil Servants (appointment, Promotion & Transfer) Rules, 1974, to be violative and discriminatory to fundamental rights guaranteed in the Constitution vide their Circular bearing No. D.Q.1(12)/2024/215 dated 23-10-2024.
It is accordingly advised to follow the instructions issued by Law Department that those candidates/applicants whose appointment order is not issued before the judgement dated 26- 09-2024 of Supreme Court of Pakistan, shall now be deemed to be null and void.”
3. It is advised to take further necessary action in deceased quota cases strictly adhering to the advice/opinion of Ruglation-Wing, SGA&CD quoted above.
