No.  1(1)R-6/2018                                                                   Islamabad, the 16th April, 2024 OFFICE MEMORANDUM Subject:        VOLUNTARY/RETIRING PENSION OF GOVERNMENT SERVANTS The undersigned is directed to refer to para 5 of this Division’s O.M No.OB.2/63-IMP(I) dated 18.08.1966 and 28.07.1966, reiterated vide O.M No. 8(5)Reg-6/73 dated04.01.1975 on the above subject and to say that according to the Article 465-B of CSR (Note-1), it is the right of all Government servants to seek Voluntary/Retiring Pension after completing 25years of qualifying service; provided that an officer who intends to retire, shall, at least three months before the date on which he/she intends to retire, should submit a written intimation to the authority competent to fill the appointment held by him at the time of submitting that intimation indicating the date on which he/she intends to retire. Such an intimation, once submitted, shall be final and cannot be modified or withdrawn. A number of cases have come to the notice of this Division in which it was found, after such an application for retirement under para 5 of the O.M dated 18.08.1966 referred to above had been submitted and accepted by the competent authority and the government servant had actually retired, that the 25 years qualifying service for pension had not been rendered e.g. the period of extra-ordinary leave had not been excluded from service.As such the government servants became altogether ineligible for pension, which caused hardship. 2.         In order to avoid recurrence of such cases in future and to avoid resultant hardshipto the retired government servant concerned it has been decided: 3.         This O.M. may be adopted in true letter and spirit. No. FD.SR-1/3-10/2004(P-II) GOVERNMENT OF THE PUNJABFINANCE DEPARTMENT Dated Lahore the 07th February, 2024 Subject:              REVISION IN FINANCIAL ASSISTANCE PACKAGE FOR THE FAMILY OF A CIVIL SERVANT Who DIES WHILE IN SERVICE In continuation of this department’s letter of even number dated 07.12.2023 and in pursuance of decision of the Caretaker Provincial Cabinet in its 35th meeting held on 10.01.2024, I am directed to state that the Governor of the Punjab has been pleased to approve following revision in the provisions of Sr. No. 1& 4 & 5 of para-1 of Financial Assistance Package notified vide Finance Department’s policy letter bearing No.FD.SR-1/3-10/2004, dated 15.08.2017 for the families of civil servants who die while in service. It shall be applicable in case of a civil servant who dies while in service on or alter 10.01.2024: 1. EDUCATION: Existing Revised Education scholarships is allowed to children of deceased civil servants (up to 3 children) out of benevolent fund as prescribed in the Punjab government servants benevolent fund Part-1&2 (disbursement) rules 1965 & 1966 Actual fees and mandatory charges which include registration fees enrolment fees, admission fees (for new admissions only) examination fees tuition fees library charges research related academic activities charges incurred on the education of children of deceased civil servants will be reimbursed for up to 3 children upon provision of original receipts from the concert institution for which mechanism may be developed by benevolent fund board unto 16 years of education from any public/private educational Institution within Pakistan 5. No. 4(3)R-4/2011                                                                 Islamabad, the 23rd January, 2024 OFFICE MEMORANDUM Subject:        CLARIFICATION ON CONSULTATION / APPROVAL OF FINANCE DIVISION IN MATTERS EFFECTING FEDERAL FINANCES The undersigned is directed to refer to the subject noted above and to state that Rule 3 of Rules of Business (RoB), 1973 provides that the Federal Secretariat shall comprise Ministries and Divisions and that the business of Federal Government shall be distributed among the Divisions. Further, Rule 4 states that each Division shall have Attached Departments and :he business of Government, other than the business done in the Federal Secretariat or the Attached Departments, shall be conducted through such agencies and offices as the Prime Minister may determine from time to time. Currently Divisions have following types of offices allocated to them: 2. Rule 12 of Rules of Business, 1973 states that “no Division shall, without previous consultation with the Finance Division, authorize the issue of any orders, other than orders in pursuance of any general or special delegation made by the Finance Division, which will affect directly or indirectly the finances of the Federation”. Instances have come to the notice of Finance Division where the offices referred to in para 1 above, especially Autonomous/Semi­ Autonomous/Corporate bodies, have contended that they enjoy financial autonomy and that their own Boards are competent to take their financial decisions. Such decisions have frequently included sanctioning of new allowances or enhancing rates of existing allowances. 3. It is clarified that offices and organizations are created by the Federal Government to facilitate the essential functions performed by the Federal Government. In some cases, operational independence is granted to such offices, mostly autonomous/Semi Autonomous Bodies, referred to in para 1 above to ensure performance of Government business, in an impartial and timely manner. However, such offices (a) either draw financial support directly from the federal government through budgetary processes or (b) have been authorized, mostly through -legislation, by the Federal Government to generate revenues which fall within tie definition of (a) Charges/fees/ cesses or (b) taxes or (c) dividends and profit. Such offices have been granted independence to incur their expenditures from such revenue as authorized by tie Federal Government/Finance Division. Amendments in relevant laws of such offices as well as Public Finance Management Act, 2019 stipulate that such offices have to deposit, after incurring their authorized expenditures, their annual surpluses in the Federal Consolidated Fund. 4. Offices referred to in para 1, in the performance of their functions, either (a) place a charge on Federal Finances or (b) consume what should be government revenue in the form of tax/fee/cess etc thereby reducing federal governments receipts to that extent. This attracts Rule 12 of Rules of Business 1973. 5. GOVERNMENT OF PAKISTANFinance Division (Regulation Wing) Islamabad, the 20th August, 2012 NOTIFICATION S.R.O. 70(KE)/2012: In exercise of the powers conferred by sub-section (1) of Section-25 of the Civil Servants Act, 1973 (LXXI of 1993), read with Notification No. S.R.O.120(1)/1998, dated the 27th February, 1998, the Prime Minister has been pleased to direct that the following further amendments shall be made in the Revised Leave Rules, 1980, namely:- (I)In sub-rule (2), for the words “one hundred and eighty” the words “three hundred and–sixty-five” Shall be substituted; (243)Price : Rs. 2.00 (ii) after sub-rule (2), amended as aforesaid, the following new sub-rules shall be inserted, namely:– “(2A) Encashment of leave preparatory to retirement (LPR).not exceeding three hundred and sixty five days shall be effective from the first day of July, 2012 and shall, for the entire period of leave refused or opted for encashment, be applicable to a civil servant retired or, as the case may be, retiring on or after the first day of July 2012, provided such leave is available at his credit subject to a maximum of three hundred and sixty five days. (2B)     the encashment of LPR shall also be applicable to employees of the autonomous and semi-auto-nomous bodies under Administrative control of the Federal Government which have adopted basic pay scales scheme and these rules in toto”.         (iii) for sub-rule (3) the following shall be substituted, namely: “(3)      If at any time during such period; leave is granted on account of ill health supported by medical certificate or for performance of –Hajj, the amount of cash compensation on account of leave pay shall be reduced by an amount equal to the leave pay for the period of leave so granted”, and  (iv) after sub-rule (5) the, following new sub-rule shall be addednamely:— “(6)     Leave pay for the purpose of encashment of LPR shall be computed, on the basis of pay and allowances reckonable towards. pension as shown in the last pay certificate of a civil servant”. .
