New Sindh Civil Servants Act 2024 Introduces Defined Contribution Pension Scheme-Notification

To The Secretary, Provincial Assembly of Sindh. Karachi. SUBJECT:- THE SINDH CIVIL SERVANTS (AMENDMENT) BILL, 2024. I am directed to refer to the subject noted above and to forward herewith a copy of the Sindh Civil Servants (Amendment) Bill, 2024, duly approved by the Cabinet, for arranging its introduction in the Assembly. The Statement of Objects and Reasons, Notice of Introduction and Motion, duly signed by the Member-in-charge will be furnished in due course of time. SECTION OFFICER (LEGISLATION)FOR SECRETARY TO GOVT. OF SINDH A BILL to amend the Sindh Civil Servants Act, 1973. WHEREAS it is expedient to amend the Sindh Civil Servants Act, 1973 in the manner hereinafter appearing; It is hereby enacted as follows:- (2) It shall come into force at once. 2.         In the Sindh Civil Servants Act, 1973, hereinafter referred to as the said Act, for section 13, the following shall be substituted:-    “13. Retirement from service. (I) A civil servant shall retire from service — Provided that no civil servant shall be retired unless he has been informed in writing of the grounds of the action proposed to be taken against him and has been given reasonable opportunity of showing cause against that action; or (2) A Civil servant appointed on regular basis in the prescribed manner, on or after the commencement of the Sindh Civil Servants (Amendment) Act, 2024, shall upon retirement from service be entitled to benefits; as prescribed in the Defined Contribution Pension Rules to be framed by the Government.”. 3.         In the said Act, for section 20, the following shall be substituted:- “20. Pension and gratuity.- (1) On retirement from service, a civil servant, appointed on regular basis in the prescribed manner, before the commencement of the Sindh Civil Servants (Amendment) Act, 2024, shall be entitled to receive such pension or gratuity as are admissible to him under the pension rules for the time being in force. (2) In the event of the death of a civil servant, appointed on regular basis in the prescribed manner, before the commencement of the Sindh Civil Servants (Amendment) Act, 2024, whether before or after retirement, his family shall be entitled to receive such pension, or gratuity, or both, as may be prescribed. (3) No pension shall be admissible to a civil servant, appointed on regular basis in the prescribed manner, before the commencement of the Sindh Civil Servants (Amendment) Act, 2024, who is dismissed or removed from service for reasons of discipline; provided that Government may sanction compassionate allowance to such a civil servant not exceeding two-thirds of the pension or gratuity which would have been admissible to him, had he been invalidated from service on the date of such dismissal or removal. (4) If the determination of the amount of pension or gratuity admissible to a civil servant appointed on regular basis in the prescribed manner, before the commencement of the Sindh Civil Servants (Amendment) Act, 2024, is delayed beyond one month of the date of his retirement or death, he or his family, as the case may be, shall he paid provisionally such anticipatory pension or gratuity as may be determined by the prescribed authority, according to the length of service of the civil servant which qualifies for pension or gratuity; and any over payment consequent on such provisional payment shall be adjusted against the amount of pension or gratuity finally determined as payable to such civil servant or his family. (5) A person appointed or regularized, regardless of the effective date of regularization in case of the later, as civil servant on or after the commencement of the Sindh Civil Servant (Amendment) Act, 2024, shall, for all intents and purposes. be civil servant, except for the purpose of pension and gratuity; and he shall participate in a Defined Contribution Pension Scheme as may be prescribed. Such a civil servant shall, in lieu of pension and gratuity, be entitled to receive such amount contributed by him towards the Contribution Pension Fund, along with the contributions, made by Government to his account in the said Fund, in the prescribed manner. Provided that in the event of death of such civil servant whether before or after his retirement, his family shall be entitled to receive the amount of Contribution Pension Fund, as prescribed in the Defined Contribution Pension Rules to be framed by the Government.”. STATEMENT OF OBJECTS AND REASONS. Due to mammoth increase in pension bill alarmingly, over a period of last decade, a large portion of provincial budget is being spent upon the pension liabilities. According to a study on actuarial valuation of Employee Benefit Scheme, it was revealed that, from financial year 2015-16 to 2018-19 the Current Revenue Expenditure (CRE) grew at the average annual rate of 18.2%. the Employees Related Expenses (ERE) grew at average annual rate of 15.3% but the Pension Bill grew twice, in comparison to other variables at an average annual rate of 30.8%. Due to such extraordinary burden at present and keeping in view the future estimations, the Government of Sindh is considering to introduce a Defined Contribution Pension Scheme for the new entrants (civil servants) joining the service on or after 01st July, 2024. Such scheme shall contain mutual monthly contributions by the civil servants themselves and the Government, for post-retirement financial security of the civil servants, and shall serve as a viable alternate of the current defined benefit pension scheme. Hence, in order to minimize the extraordinary burden upon the public exchequer in future and to provide for the matters ancillary thereto, it is expedient amend the Sindh Civil Servants Act, 1975. Punjab PPRA Clarifies Bid Submission Timeline: Response Time to Exclude Date of Advertisement-Notification

GOVERNMENT OF THE PUNJAB PUNJAB PROCUREMENT REGULATORY AUTHORITYSERVICES AND GENERAL ADMINISTRATIONDEPARTMENT Dated Lahore, the 20th September, 2024 CIRCULAR No. L&M(PPRA)10-1/2011. Under Rule 14(1) of Punjab Procurement Rules 2014 (PPR-14) all procuring agencies are bound to provide a response time of minimum fifteen (15) days for National competitive bidding process and thirty (30) days for International competitive bidding process for the submission of bids. The mechanism to calculate “response time” has been provided under Rule 14(3) of PPR-14 whereby it has been mentioned that response time shall be calculated from the date of publication of advertisement. The Rule ibid is reproduced as under: 14. Response time.- (1) The procuring agency may decide the response time for receipt of bids or proposals (including proposals for prequalification) from the date of publication of an advertisement or notice keeping in view the complexity of the procurement, availability and urgency but, in no circumstances, the response time shall be less than fifteen days for national competitive bidding and thirty days for international competitive bidding from the date of publication of advertisement or notice. (3) The response time shall be calculated from the date of publication of the advertisement on the website. 2.                     Matter has been examined under Rule 14 of Punjab Procurement Rules 2024 (PPR-14) read with Section 8 of the Punjab General Clauses Act, 1956 (West Pakistan Act VI of 1956). The Section ibid stipulates as under: 8. Commencement and termination of time — In any (11)(Punjab Act], it shall be sufficient, for the purpose of excluding the first in a series of days or any other period of time to use the word “from” and for the purpose of including the last in a series of days or any other period of time to use the word “to” 3.                     It is clarified for information of all the Procuring Agencies across Punjab that the phrase “from the date of publication” mentioned in Rule 14(3) of PPR-14 shall be interpreted to exclude the date of publication of advertisement from the cycle/series of fifteen (15) days or thirty (30) (whichever is applicable). 3.                 In view of above, all Procuring Agencies are advised to calculate the response time for the submission of bids by excluding the date of publication of advertisement from the cycle/series of fifteen (15) days or thirty (30) whichever is applicable. New Amendments in Punjab Procurement Rules (PPRA) 2014: Streamlined Bidding and Complaint Process Introduced-Notification

GOVERNMENT OF THE PUNJABSERVICES & GENERAL ADMINISTRATION DEPARTMENT(Implementation & Coordination Wing) Dated Lahore the 20th September, 2024 NOTIFICATION No. SO(CAB-I) 2-9/2015.-     In exercise of the powers conferred under section 26 of the Punjab Procurement Regulatory Authority Act, 2009 (VIII of 2009), Governor of the Punjab is pleased to make the following amendments in the Punjab Procurement Rules 2014, with immediate effect:- AMENDMENTS In the Punjab Procurement Rules 2014: 1.            In rule 12: (a)         In sub-rule (1)             (b)       sub-rule (2) shall be omitted. 2.         In rule 14, in sub-rule (3): 3.            In rule 25:         (a)       in sub-rule (1), at the end, the following shall be inserted: “The procuring agency shall upload the complete bidding documents on the website of the Authority.                                 Explanation: – In this rule, uploading of the complete bidding documents means that the procuring agency shall upload the bidding documents at the time of uploading of tender advertisement”; and         b)         for sub-rule (7), the following shall be submitted: “(7) The bidder shall download the bidding documents from the website of the Authority and participate in the procurement process without paying any cost or fee.”. 4.         In rule 59:             (a)       in clause (a):                        (i)           for the word “below”, the word “upto” shall be substituted; and                   (ii)          for the word “seventy five”, the words “two hundred” shall be substitute and                (b)          in clause (b):                               (i)           for the word “seventy live,” the word “two hundred” shall be substitute and                               (ii)          for the words “but less than”, the words “and upto” shall be substitute and (iii)        for the word “two”, the word ‘five” shall be substituted. 5.            For rule 67, the following shall be substituted: “67. Redressal of grievances by the procuring agency.- (1 procuring age, shall constitute a Grievance Redressal Corn, comprising of odd number of persons, with proper powers authorizations, to address the complaints of bidders that may occur to the entry into force of the procurement contract.                                              (2)          The Committee may: (a) decide the complaint lodged by any bidder before the pre submission date;                                                             (b) set aside the decision of technical evaluation committee;                                                             (c) uphold the decision of technical evaluation committee;                                                             (d) modify the decision of technical evaluation committee; and (e) recommend scrapping of the procurement process reasons to be recorded in writing.                                              (3)          Any bidder feeling aggrieved by any act of the procuring agency after the submission of his bid may lodge a written complaint concerning his grievances within five days of announcement & technical evaluation report and ten days after issuance of final evaluation report.                                              (4) In case, the complaint is filed after the issuance of the evaluation report, the complainant cannot raise any objection on technical evaluation of the report. Provided that detail technical evaluation report has been uploaded on the website of the Authority:                                              Provided further that the complainant may raise the objection or part of the final evaluation report in case where single stage envelope bidding procedure is adopted.                                              (5) The Committee shall investigate and decide the complaint within fifteen days of the receipt of the complaint.”                6.            After rule 67, the follow, shall be Inserted:                “67A. Representation or complaint before the Managing Director.- (1) Any bidder aggrieved by any decision of the Grievances Redressal Committee may file a representation before the Managing Director within seven days of communication of the decision.                               (2) The Managing Director may suspend the procurement proceedings till the final decision:                               Provided that mere filling of a representation does not rnean suspension of the procurement process.                               (3) In case of violation of any provision of the rules, not being a grievance as mentioned under rule 67 of the rules, any person may file a complaint before the Managing Director.                               (4) The decision of the Managing Director on representation or complaint, as the case may be, shall be final.                               (5) A fee, to be decided by the Authority from time to lee, in shape of demand draft shall be submitted in the name of the Managing Director for filing a representation or complaint, as the case may be. The refund of such fee in case of true and genuine representation or complaint and forfeiture in case of false and frivolous representation or complaint shall be decided by the Managing Director on case to case basis.”. Guidelines for Enhancing Educational Standards in Privately Managed Schools The teaching profession holds a unique and invaluable place in society, shaping the minds and futures of the next generation. Teachers are the cornerstone of intellectual development, guiding students not only toward academic excellence but also personal growth. Their dedication and expertise lay the foundation for the future success of their students. Recognizing the importance of this noble profession, it is imperative that schools continuously strive to enhance their teaching practices and create an environment conducive to holistic development. However, there are growing concerns about the current practices in many private schools. Despite schools claiming adherence to high teaching standards, there has been an increase in students turning to tuition centers for additional academic support. It is troubling to observe that, in many classrooms of more than 25 students, the majority attend external tuition centers. This raises critical questions: Are all these students struggling academically? If schools are meeting educational standards, why is additional tuition necessary? Moreover, when students achieve success, tuition centers often take credit, posting the students’ achievements on social media and promoting their faculty as superior. Simultaneously, schools claim that the success is a result of their teaching staff. In this scenario, parents are left bearing the financial burden of paying both school fees and tuition fees, placing them in a difficult position. More importantly, the students themselves suffer. The increased academic pressure leaves little time for physical activities or adequate rest, leading to rising cases of depression, anxiety, and physical ailments such as back and neck pain. To address these challenges and foster a more supportive and balanced educational environment, we propose the following guidelines for school administrators: Schools must place greater emphasis on supporting students who are academically struggling. Rather than encouraging a reliance on external tuition, schools should establish in-house remedial programs and provide additional help to those in need. A collaborative effort, where academically stronger students assist weaker peers, can also be promoted. Teachers must create a classroom atmosphere where students feel comfortable asking questions. Shouting at or discouraging students from inquiring further into subjects can lead to feelings of inadequacy, anxiety, and depression. Teachers should be trained to handle student queries with patience and care, fostering an environment of curiosity and learning rather than fear. Schools must strike a balance between academic rigor and the physical and emotional well-being of students. Daily schedules should include time for physical activities and breaks that allow students to recharge. Additionally, schools should educate students about the importance of sleep and self-care as part of a healthy lifestyle. School administrations should closely monitor classroom activities to ensure that learning is effective and comprehensive. Success should not be measured only by grades but also by how well students grasp concepts. Teachers must take responsibility for ensuring that every student is progressing and not simply passing without understanding. Evaluating a teacher’s commitment to improving their skills by attending workshops, pursuing advanced certifications, or engaging in continuous learning. Teaching Portfolio: Reviewing a collection of teaching materials, lesson plans, and student work samples that demonstrate the teacher’s planning, assessment, and instructional strategies. Schools should nurture a culture of mutual respect and encouragement, where students of all levels are valued. Peer-to-peer learning, support groups, and mentorship programs should be implemented to help bridge the gap between stronger and weaker students, thereby reducing the need for external tuition. By adopting these guidelines, schools can create an academic environment that prioritizes the well-being of students while promoting a culture of learning, support, and success. Teachers, administrators, and parents must work together to ensure that students receive the care and attention they need—both academically and emotionally–within the school setting.
