Lahore High Court Orders Early Disposal of Stay Applications under Order XXXIX CPC – Official Directive Issued
Notification / OM No. No 5636/PE&CB/DDJ/NJPMC Dated 10-May-2025 Notification Issued By: Directorate Of District Judiciary, Lahore High Court, Lahore Punjab Judiciary Told to Expedite Stay Application Cases as Per CPC Guidelines: In a move aimed at speeding up civil litigation processes in Punjab, the Lahore High Court has issued a fresh directive to all District & Sessions Judges across the province regarding the early disposal of stay applications and civil appeals. As per the official Government Notification No. 5636/PE&CB/DDJ/NJPMC, dated 10th May 2025, the Hon’ble Chief Justice has ordered all judicial officers to strictly follow the time limits laid down in the National Judicial Policy Making Committee (NJPMC) 2009, Revised Edition 2012. The instructions specifically emphasize that stay applications under Order XXXIX Rules 1 & 2 of the CPC (Civil Procedure Code, 1908) must be disposed of within 15 days. Moreover, civil appeals, especially those involving stay matters filed under Section 104 read with Order XLIII Rule 1 CPC, which are pending for more than three months, must be decided within one month from now. This notification is expected to reduce delays and backlog in civil litigation and is part of broader judicial reforms for speedy justice in Pakistan.
