Punjab PPRA Clarifies Bid Submission Timeline: Response Time to Exclude Date of Advertisement-Notification

GOVERNMENT OF THE PUNJAB PUNJAB PROCUREMENT REGULATORY AUTHORITYSERVICES AND GENERAL ADMINISTRATIONDEPARTMENT Dated Lahore, the 20th September, 2024 CIRCULAR No. L&M(PPRA)10-1/2011. Under Rule 14(1) of Punjab Procurement Rules 2014 (PPR-14) all procuring agencies are bound to provide a response time of minimum fifteen (15) days for National competitive bidding process and thirty (30) days for International competitive bidding process for the submission of bids. The mechanism to calculate “response time” has been provided under Rule 14(3) of PPR-14 whereby it has been mentioned that response time shall be calculated from the date of publication of advertisement. The Rule ibid is reproduced as under: 14. Response time.- (1) The procuring agency may decide the response time for receipt of bids or proposals (including proposals for prequalification) from the date of publication of an advertisement or notice keeping in view the complexity of the procurement, availability and urgency but, in no circumstances, the response time shall be less than fifteen days for national competitive bidding and thirty days for international competitive bidding from the date of publication of advertisement or notice. (3) The response time shall be calculated from the date of publication of the advertisement on the website. 2.                     Matter has been examined under Rule 14 of Punjab Procurement Rules 2024 (PPR-14) read with Section 8 of the Punjab General Clauses Act, 1956 (West Pakistan Act VI of 1956). The Section ibid stipulates as under: 8. Commencement and termination of time — In any (11)(Punjab Act], it shall be sufficient, for the purpose of excluding the first in a series of days or any other period of time to use the word “from” and for the purpose of including the last in a series of days or any other period of time to use the word “to” 3.                     It is clarified for information of all the Procuring Agencies across Punjab that the phrase “from the date of publication” mentioned in Rule 14(3) of PPR-14 shall be interpreted to exclude the date of publication of advertisement from the cycle/series of fifteen (15) days or thirty (30) (whichever is applicable). 3.                 In view of above, all Procuring Agencies are advised to calculate the response time for the submission of bids by excluding the date of publication of advertisement from the cycle/series of fifteen (15) days or thirty (30) whichever is applicable. New Amendments in Punjab Procurement Rules (PPRA) 2014: Streamlined Bidding and Complaint Process Introduced-Notification

GOVERNMENT OF THE PUNJABSERVICES & GENERAL ADMINISTRATION DEPARTMENT(Implementation & Coordination Wing) Dated Lahore the 20th September, 2024 NOTIFICATION No. SO(CAB-I) 2-9/2015.-     In exercise of the powers conferred under section 26 of the Punjab Procurement Regulatory Authority Act, 2009 (VIII of 2009), Governor of the Punjab is pleased to make the following amendments in the Punjab Procurement Rules 2014, with immediate effect:- AMENDMENTS In the Punjab Procurement Rules 2014: 1.            In rule 12: (a)         In sub-rule (1)             (b)       sub-rule (2) shall be omitted. 2.         In rule 14, in sub-rule (3): 3.            In rule 25:         (a)       in sub-rule (1), at the end, the following shall be inserted: “The procuring agency shall upload the complete bidding documents on the website of the Authority.                                 Explanation: – In this rule, uploading of the complete bidding documents means that the procuring agency shall upload the bidding documents at the time of uploading of tender advertisement”; and         b)         for sub-rule (7), the following shall be submitted: “(7) The bidder shall download the bidding documents from the website of the Authority and participate in the procurement process without paying any cost or fee.”. 4.         In rule 59:             (a)       in clause (a):                        (i)           for the word “below”, the word “upto” shall be substituted; and                   (ii)          for the word “seventy five”, the words “two hundred” shall be substitute and                (b)          in clause (b):                               (i)           for the word “seventy live,” the word “two hundred” shall be substitute and                               (ii)          for the words “but less than”, the words “and upto” shall be substitute and (iii)        for the word “two”, the word ‘five” shall be substituted. 5.            For rule 67, the following shall be substituted: “67. Redressal of grievances by the procuring agency.- (1 procuring age, shall constitute a Grievance Redressal Corn, comprising of odd number of persons, with proper powers authorizations, to address the complaints of bidders that may occur to the entry into force of the procurement contract.                                              (2)          The Committee may: (a) decide the complaint lodged by any bidder before the pre submission date;                                                             (b) set aside the decision of technical evaluation committee;                                                             (c) uphold the decision of technical evaluation committee;                                                             (d) modify the decision of technical evaluation committee; and (e) recommend scrapping of the procurement process reasons to be recorded in writing.                                              (3)          Any bidder feeling aggrieved by any act of the procuring agency after the submission of his bid may lodge a written complaint concerning his grievances within five days of announcement & technical evaluation report and ten days after issuance of final evaluation report.                                              (4) In case, the complaint is filed after the issuance of the evaluation report, the complainant cannot raise any objection on technical evaluation of the report. Provided that detail technical evaluation report has been uploaded on the website of the Authority:                                              Provided further that the complainant may raise the objection or part of the final evaluation report in case where single stage envelope bidding procedure is adopted.                                              (5) The Committee shall investigate and decide the complaint within fifteen days of the receipt of the complaint.”                6.            After rule 67, the follow, shall be Inserted:                “67A. Representation or complaint before the Managing Director.- (1) Any bidder aggrieved by any decision of the Grievances Redressal Committee may file a representation before the Managing Director within seven days of communication of the decision.                               (2) The Managing Director may suspend the procurement proceedings till the final decision:                               Provided that mere filling of a representation does not rnean suspension of the procurement process.                               (3) In case of violation of any provision of the rules, not being a grievance as mentioned under rule 67 of the rules, any person may file a complaint before the Managing Director.                               (4) The decision of the Managing Director on representation or complaint, as the case may be, shall be final.                               (5) A fee, to be decided by the Authority from time to lee, in shape of demand draft shall be submitted in the name of the Managing Director for filing a representation or complaint, as the case may be. The refund of such fee in case of true and genuine representation or complaint and forfeiture in case of false and frivolous representation or complaint shall be decided by the Managing Director on case to case basis.”. No 4230-3/AD (Lit: II)                                                                                                 Dated Peshawar the 13/08 /2024 Subject: – DETERMINATION OF SENIORITY OF TEACHERS, REGULARIZED UNDER THE KHYBER PAKHTUNKHWA E&SE DEPARTMENT (APPOINTMENT & REGULARIZATION OF SERVICES) ACT, 2017. Memo: 1 am directed to refer to the consolidated judgment dated 31-05-2023 of the Honorable Khyber Pakhtunkhwa Service Tribunal, Peshawar in Service Appeals No. 2069/2019 etc. under the titled: Abid Noor Vs Govt: of KP & subsequent guidance letter No. NO. ALO(OP)LD/15-2/2023/KC.7405-7408 dated 20-05-2024 of law Department conveyed to this Directorate vide letter No. SO (Primary-M) E&SED/4-7/seniority of PSTs under Act. 2017/court cases/2024 dated 26-06-2024 by the Admin Department, wherein, it has been held that: “Leaving aside the judgment of the Honorable Service Tribunal dated 31-05-2023 in Service Appeals No. 2069 to 2079/2019, the benefits of Section-4 (2) of the (Appointment & Regularization of Services) Act, 2017 may be extended to all the employees, regularized under the said Act after advice of the scrutiny committee meeting held on dated 06-09-2023.. To elaborate further, Section-4(2) of the (Appointment & Regularization) Act, 2017. is hereby reproduced in verbatim for perusal: 4. Determination of Seniority. (1),………………………………………………………….      (2). The seniority inter-se of those employees. whose services are regularized under this Act within the Cadre shall be determined on the basis of their continuous service in cadre. provided that if the date of continuous service in the case of two or more employees is the same. the employee older in age shall rank senior to the younger one.” As sequel to the fore-made discussion, citation of the relevant provision of law & Judgment dated 31-05-2023 of the learned Tribunal, it is hereby intimated that seniority of the teachers who have been regularized under the Act, 2017 be determined in light of the Section-4 (2) of the Act ibid in view of their continuous service in the cadre from the date of appointment and if continuous service of two or more teachers is the same, the employee older in age shall rank senior to the younger one please.
